Terms of Service

Last updated: August 14, 2026

These terms apply to Upstream Initiative LLC and the products we build and operate, including Partner Punch List, growAware, and Upstream Approach. Each product may also have its own product-specific terms for details unique to that product; where they conflict, the product-specific terms take priority for that product.

Our Products

We build practical, privacy-first software. Products are provided as-is, for the purpose described on their respective pages. None of our products are safety-critical, medical, or emergency tools, don't rely on them for anything where an outage or bug would cause real harm.

Your Account

You're responsible for keeping your account credentials secure. If you believe your account has been accessed without your permission, contact upstreaminitiative@outlook.com.

Content You Add

You own the content you add to our products. We store and display it back to you (and anyone you've shared it with, like household members), and don't use it for anything else. You're responsible for what you post, don't add content that's illegal, harmful, or that you don't have the right to share.

Payments & Refunds

Paid products or plans are billed and processed by Paddle.com, our reseller and Merchant of Record. Paddle.com will appear on your card or bank statement, not Upstream Initiative.

Recurring (monthly/yearly) plans include a 7-day free trial before your card is charged; you can cancel anytime during the trial and you won't be charged. All purchases, whether one-time or recurring, are refundable within 14 days of purchase. Contact upstreaminitiative@outlook.com to request a refund, or see Paddle's own refund policy for full details.

Availability

We aim to keep our products running reliably, but we don't guarantee uninterrupted access.

Account and Data Deletion

You can request deletion of your account and data at any time, see our Privacy Policy for details. Once deleted, it's not recoverable.

Changes to These Terms

Our products change as they're actively developed. If these terms change in a meaningful way, we'll update the date above.

Limitation of Liability

Our products are provided as-is, without warranties of any kind. We're not liable for lost data, missed reminders, or any damages arising from use of our products, to the fullest extent permitted by law.
